1. Acceptance of Terms

By accessing or using the Hynds AI Accounting platform (“the Service”), operated by Hynds AI (“we,” “us,” or “our”), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Hynds AI Accounting is a cloud-based bookkeeping and accounting platform that provides AI-powered transaction categorization, financial reporting, invoicing, expense tracking, and related tools for small and medium-sized businesses.

3. Account Registration & Security

Accounts are provisioned by Hynds AI. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use. We strongly recommend enabling Multi-Factor Authentication (MFA) for all accounts.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to any part of the Service, its servers, or any connected systems.
• Transmit malicious code, viruses, or any other harmful technology.
• Use the Service to store or transmit content that infringes on intellectual property rights.
• Resell, sublicense, or redistribute the Service without written permission.

5. Data Ownership & Privacy

You retain full ownership of any data you upload, enter, or generate through the Service (“Your Data”). We do not sell or share Your Data with third parties except as required to operate the Service or as required by law. Our handling of personal information is described in our Privacy Policy.

6. AI-Powered Features

Certain features of the Service use artificial intelligence and machine learning to assist with transaction categorization, receipt processing, and data extraction. While we strive for accuracy, AI-generated outputs are provided as suggestions and should be reviewed by a qualified individual. Hynds AI is not a licensed accounting firm and does not provide professional accounting, tax, or legal advice.

7. Service Availability

We aim to provide reliable access to the Service but do not guarantee uninterrupted or error-free operation. We reserve the right to perform maintenance, updates, or modifications that may temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

8. Payment & Billing

If you subscribe to a paid plan, you agree to pay all applicable fees. Fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Stripe is used to process payments — your payment data is handled by Stripe in accordance with their terms and PCI-DSS standards.

9. Limitation of Liability

To the maximum extent permitted by law, Hynds AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Hynds AI, its officers, directors, and employees from any claims, damages, or expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. You may request an export of Your Data within 30 days of termination.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Spokane County, Washington.

13. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify registered users of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
